Property Settlement

The division of property, including superannuation where applicable, following the breakdown of a marriage or de facto relationship.  This can be achieved through negotiated settlement, mediation or, if needed, proceedings in the Family Court of Western Australia.

 

Children’s Issues

Arrangements for children include who they live with, where they live, and what time they spend with each parent.  Our focus is on reaching a negotiated agreement based on the best interests of the child.  We offer advice on the pathways to achieving an agreement, such as Family Dispute Resolution, negotiations, mediation or, if necessary, initiating or responding to proceedings in the Family Court of Western Australia.

 

Consent Orders

The preparation and drafting of Orders where an agreement has been reached.  This can be either through an Application for Consent Orders filed in the Family Court, or the finalisation of a matter where there are proceedings in the Family Court.  Consent Orders can be made in both property and children’s matters.

 

Proceedings in the Family Court of Western Australia

Advice and representation in all matters heard in the Family Court of Western Australia, with the briefing of Counsel, where appropriate.  The Family Court is located in Perth, but travels to Albany for 3 Magistrate and 3 Judicial circuits each year.  We can appear in Perth, either in person or by telephone, or have the matter listed to be heard in Albany on circuit.

 

Binding Financial Agreements

A written agreement setting out how property is to be divided in the event of a breakdown of a marriage or de facto relationship.  Binding Financial Agreements can be entered into before, during or after a marriage or de facto relationship.

 

Divorce

The formal ending of a marriage.  A divorce can be applied for following 12 months of separation and can be either a joint or sole application.  We offer a fixed fee for the preparation of an Application for Divorce and attendance at Court, if necessary.

 

Spousal Maintenance

The ongoing financial support of one party to the marriage or de facto relationship.  Spousal Maintenance may be payable where one party is unable to adequately support themselves, and the other party has the financial capacity to support their former spouse.

Enduring Powers of Attorney and Guardianship

The appointment of a trusted person or persons to make financial decisions (Enduring Powers of Attorney) or personal lifestyle,and health decisions (Enduring Power of Guardianship) in the event the capacity to make decisions has been lost or compromised.

 

Probate and Letters of Administration

The preparation of an Application to the Supreme Court for a Grant of Probate or Letters of Administration on behalf of an Executor or Executors of a deceased estate.
